The court returned almost 10 hectares of land on the embankment to Vyshogorod.
The господар court of the Kyiv region ordered the return of a land plot with an area of over 9,5 hectares on the embankment to the Vyshorod community, which the city council leased to a private company in violation of the law. The Kyiv regional prosecutor's office has proven that the area of the plot was illegally increased by two times.
The Economic Court of the Kyiv region ordered the return of a land plot belonging to the water area, with an area of more than 9,5 hectares, to the Vyshorod territorial community on the city's embankment.
The Kyiv regional prosecutor's office has filed a lawsuit, stating that the city council leased the land to a private company in violation of land and water laws. According to the prosecutor's office, the land, measuring over 4 hectares, was initially leased on Naberezhna Street in Vyshorod.
Later, the actual area of the leased land increased more than twofold – to 9,5354 hectares, although no changes were made to the lease agreement. The prosecutors also proved that the lease agreement for another plot of land with an area of 5,5 hectares had expired in 2006 year, and the current agreement, signed in 2012 year, only covered a plot of land with an area of 4,0354 hectares.
The court fully satisfied the prosecution's claims, overturning the decisions of the state registrars regarding the registration of the land lease and the change in the area of the land plot. The court deemed the land lease agreement invalid and ordered the plot to be returned to the territorial community of Vyshorod.
